Please read the following terms and conditions (“Terms”) for Albertsons Health LLC.’s Food Is Medicine program ("FIM"). These Terms constitute an agreement between you and Albertsons Health LLC. (hereinafter “Albertsons Health”) directly or through or one or more Albertsons Companies, Inc. banner stores or retail subsidiaries, such as ACME, Balducci’s, Jewel-Osco, Kings Food Markets, Pavilions, Randalls, Safeway, Shaw’s, Star Market, Tom Thumb, and Vons (collectively, “Albertsons”, "Company", "we", “our” and "us"). By accessing, participating, and/or using FIM, you acknowledge that you have read and agree to be bound by these Terms, and the Albertsons Companies, Inc.’s Health & Pharmacy Application Terms of Use, HIPAA Notice of Privacy Practices, and Privacy Policy, each of which are specifically incorporated herein by reference. In these Terms, the terms "you" and "your" include all persons who use and/or participate in the Program. Capitalized terms not defined herein shall have the meaning so ascribed to them in the Health & Pharmacy Application Terms of Use.
NOTE: These Terms are in addition to the Health & Pharmacy Application Terms of Use, HIPAA Notice of Privacy Practices, and the Privacy Policy.
ATTENTION: THESE TERMS CONTAIN A MANDATORY ARBITRATION PROVISION THAT, AS FURTHER ADDRESSED IN SECTION 26 OF THE HEALTH & PHARMACY APPLICATION TERMS OF USE AND OUR DISPUTE RESOLUTION TERMS REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES. THIS MEANS THAT YOU AND THE COMPANY ARE EACH GIVING UP THE RIGHT TO SUE EACH OTHER IN COURT OR IN CLASS ACTIONS OF ANY KIND. IN ARBITRATION, THERE IS NO JUDGE OR JURY.
We reserve the right to update these Terms from time to time by notifying you of such changes by any reasonable means, including by posting revised Terms through the Sites. Any such changes will be effective immediately upon being posted on the Sites. The “Last Updated” legend at the top of this page indicates when these Terms were last changed. Your continued use and/or access of FIM and/or the Site after a posted change in these Terms will constitute your acceptance of and agreement to such changes.
1. FIM PROGRAM
Albertsons Health’s Food Is Medicine Program offers; (1) Medically Tailored Grocery bundles and recipes, (2) Nutrition and Dietician Services and (3) Medically Tailored Meals (MTM) to eligible individuals. FIM is offered at the sole discretion of Albertsons Health. Accessing and/or use of FIM, or any part thereof, is subject to and governed by these Terms and Company’s, Health & Pharmacy Application Terms of Use, HIPAA Notice of Privacy Practices, and Privacy Policy.
FIM is available to individuals who have FIM covered benefits and Albertsons Health is a member of their Health Plan provider network to provide those benefits. The FIM program is for their personal use only and is limited to one account per individual. FIM is a program that focuses on integrating diet- and nutrition- related resources with curated grocery product bundles, as a helpful resource in connection with addressing chronic diseases. Company provides nutrition and registered dietician services through Surely Health, Inc. and Season Clinical Care, P.A. (“Season”). You should not use FIM services for self-diagnosis Follow the advice of your healthcare provider. Always seek the guidance of your healthcare provider or other qualified medical professionals regarding any questions you may have about your health, medical conditions, or dietary needs. Do not disregard or delay seeking professional medical advice based on information provided through this program.
Participation in the FIM program does not establish a doctor-patient relationship. The program does not endorse or recommend any specific medical treatments, products, or services. Any decisions regarding your health should be made in consultation with your healthcare provider.
Orders for Offerings placed through FIM are subject to the Company’s Online Ordering Services Terms. To use FIM, you must have a Sincerely Health account and a forU Loyalty Account. All information provided to Company in connection with FIM is subject to our HIPAA Notice of Privacy Practices and Privacy Policy. HIPAA Notice of Privacy Practices and Privacy Policy.
FIM is not available for all health plans or all health conditions. The Company partners with certain eligible health plans, at its sole discretion. Company may add or remove available eligible health plans for FIM from time to time, without notice to you, at Company’s sole discretion. Company may modify eligibility requirements for FIM from time to time, in its sole discretion, without notice to you. FIM benefits and coverage are determined by your health plan. Company shall have no liability to you related to the benefits or coverage offered by your health plan, or whether your health plan or health condition is eligible, for FIM or other similar food is medicine or food as medicine programs.
Virtual dietician services including visits may be available in connection with FIM. Accessing or use of any such services, are subject to these terms. Dietician services may differ by health plan and location, please see additional terms below.
2. VIRTUAL DIETICIAN SERVICES
You may access certain nutrition and dietician services through FIM. Nutrition and dietician services may include virtual dietician visits using interactive audio-video and secure messaging.
Virtual Dietician Visits. Company may connect you to registered dieticians, and/or other healthcare professionals, that are employed or contracted with a third party, who may provide virtual dietician and nutrition visits using synchronous and asynchronous telecommunications technologies (individually, a “Virtual Dietician Provider”, collectively, “Virtual Dietician Providers”). The professional services provided by the Dietician Providers are collectively referred to as “Virtual Dietician Services”. Virtual Dietician Services are subject to these terms and conditions.
3. CONFLICT
If there is a direct conflict between the provisions of these Terms and the Health & Pharmacy Application Terms of Use and/or the Online Ordering Services Terms, the provisions of these Terms will control solely with respect to FIM.
4. RISK OF TELEHEALTH SERVICES
By using Virtual Dietician Services, you acknowledge the potential risks associated with telehealth services. These include but are not limited to the following: information transmitted may not be sufficient (e.g. poor resolution of images) to allow for appropriate clinical or health care decision making by the Provider; delays in evaluation or treatment could occur due to failures of electronic equipment; a lack of access to your clinical records may result in adverse drug interactions or allergic reactions or other judgment errors; although the electronic systems we use incorporate network and software security protocols to protect the privacy and security of health information, those protocols could fail causing a breach of privacy of your health information.
5. NOT AN INSURANCE PRODUCT
We are not an insurer, nor do we offer an insurance plan or product. The amounts you pay us for any services obtained through FIM are not insurance premiums. If you desire any type of health or other insurance, you will need to purchase such insurance separately.
6. AVAILABILITY OF SERVICES
Company operates subject to state and federal regulations, and FIM may not be available in your state. You represent that you are not a person barred from enrolling for or receiving FIM under the laws of the United States or other applicable jurisdictions in which you may be located. Access to and use of FIM is limited exclusively to users located in states within the United States where FIM is available. FIM is not available to users located outside the United States. Accessing FIM from jurisdictions where content is illegal, or where we do not offer FIM, is prohibited.
7. AVAILABILITY AND SUBSTITUTIONS
Company may, without notice, apply quantity limits on any order, reject all or part of any order, discontinue offering any item or product, or make substitutions to any item or product. Company is not responsible if an item or product is unavailable. Company may substitute a similar item or product in a food order. Substituted food items may contain different ingredients and allergens. Prior to consumption, please carefully check all food packages for information regarding ingredients and nutritional information.
8. CONSENT TO AUDIO AND/OR VIDEO RECORDINGS
Company or your Dietician Provider may record (audio and video) all or part of your interaction with us or them (“Recordings”). Such Recordings are used for quality assurance and training purposes, to better deliver to you the products and services, and to help us improve the program. We will keep such Recordings confidential, and we will not publicly display such recordings unless legally required to do so, such as if subject to a court order. By accessing and using FIM, you agree and consent to such Recordings for the purposes and uses set forth in these Terms of Use and as otherwise set forth in the Privacy Policy.
9. NOT FOR EMERGENCIES
Sincerely Health and FIM services are not for medical emergencies or urgent situations. You should not disregard or delay seeking medical advice based on anything that appears or does not appear on Sincerely Health and/or our FIM program. If you believe you are experiencing an emergency, call 9-1-1 immediately.
You should seek emergency help or follow up care when recommended by a Provider or when otherwise needed. You should continue to consult with your primary provider and other healthcare professionals as recommended. Always seek the advice of a physician or other qualified healthcare provider concerning questions you have regarding a medical condition and before stopping, starting, or modifying any treatment.
10. NO USERS UNDER 18 YEARS OLD
In order to access FIM services, you represent and warrant that you are 18 years old or older. If you are under the age of 18, please do not attempt to register with us on the Platform or provide any personal information about yourself to us. If we learn that we have collected personal information from someone under the age of 18, we will promptly delete that information. 11. CONDUCT
The following will not be tolerated by Albertsons Health: Harassment; intimidation; verbal threats; use of inappropriate language, including profanity, sexual, vulgar, or rude language; or offensive comments about race, religion, gender, sexual orientation, or personal traits, or the refusal to see a clinician or associate based on these traits. Users who do not follow these guidelines may be asked to make other plans for their care and/or use of the FIM program.
12. CALIFORNIA RESIDENTS
If you are a California resident, you hereby waive California Civil Code Section 1542, which says: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.” This release includes the criminal acts of others.
California users are also entitled to the following specific consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd, Sacramento, CA 95834 or by telephone at (916) 445-1254 or (800) 952-5210.
For Medi-Cal recipients: Medi-Cal gives you the option to receive services in person or via telehealth. Medi-Cal provides coverage for transportation services for in person services when other resources have been reasonably exhausted. Telehealth has risks, such as medical evaluation or treatment delays or a failure to obtain needed treatment if an in-person follow-up visit is required. If you choose Telehealth, you may change your mind at any time by letting us know. If you change your mind about using telehealth, you will still have access to Medi-Cal covered services. By proceeding with your appointment, you acknowledge your consent to these terms.
13. FOOD SAFETY
Once FIM products are delivered, it is up to the consumer to use proper food safety techniques, including but not limited to thorough washing of raw produce, and the proper storage, cooking and disposal of meals. COMPANY’S PRODUCTS ARE GUARANTEED UP TO THE TIME OF DELIVERY AND COMPANY HEREBY DISCLAIMS ANY PRODUCT WARRANTIES THEREAFTER.
14. HEATH RELATED INFORMATION
The information contained on the Website or Interactive Services is provided for informational purposes only and is not meant to substitute for the advice provided by your doctor or other health care professional. You should not use the information available on or through the Website (including, but not limited to, information that may be provided on the Website by healthcare or nutrition professionals employed by or contracting with COMPANY) for diagnosing or treating a health problem or disease or prescribing any medication. You should carefully read all Product packaging prior to use.
