Thank you for being part of the Albertsons Companies community! As part of your shopping and pharmacy experience, you are welcome to use our guest Wi-Fi. In order to connect, please read through the Terms and Conditions below to help you better understand the Wi-Fi rules of the road.

Albertsons Companies and participating affiliates (“Albertsons,” “we,” or “us”) provide short-term access to Albertsons’ guest wireless network (“Wi-Fi”) for our guests as a courtesy and convenience on an as-needed basis. When you click to accept these Terms or access the Wi-Fi, you indicate that you have read, understand, and have the legal authority to accept the Albertsons Guest Wi-Fi Terms and Conditions (“Terms”).

We recognize that you may have junior shoppers with you as you navigate our aisles and pharmacy, and you may want them to have access to the Wi-Fi. All guests and patients under 18 will need a parent or legal guardian’s consent to use the Wi-Fi and accept the Terms.

Acceptance and Access During Each Visit

We understand that you may want to use the Wi-Fi when you visit (sometimes you just need to look up a recipe again in the store!). But before connecting, you will need to review and agree to these Terms. If you are not agreeable with the Terms after reading them, do not connect to our Wi-Fi.

Wi-Fi Speed & Availability

Albertsons provides the Wi-Fi "as is" and on an "as available" basis without warranties or guarantees of any kind regarding its speed, bandwidth, strength, and range. This means, sometimes the Wi-Fi won’t be as fast as you may want or that you may experience interruptions. We appreciate your understanding and patience.

Prohibited Use

We provide our Wi-Fi free of charge as a courtesy while you are shopping at our stores, but your access is subject to some restrictions. Some activities are prohibited on our Wi-Fi. A lot of the actions that fall under the category of prohibited conduct should not come as a surprise, such as don’t do anything illegal, interfere with our business, or do anything that harms our reputation. But, prohibited conduct also includes not interfering with the use and enjoyment of other Wi-Fi users or infringing on the intellectual property or privacy rights of others. To provide context, below are some examples of prohibited conduct:

  • Stay in your own lane: Do not attempt to intercept, interfere, or gain unauthorized access to transmissions or communications not belonging to you. And, don’t do anything that causes an unreasonable or disproportionate load on the Wi-Fi or any other resources accessed through the Wi-Fi (for example, downloading your favorite movie should be done at home).
  • Don’t SPAM (electronic, not the tasty meat): Do not send or indirectly aid in the transmission of “spam,” chain letters, or other unsolicited communications.
  • Be Authentic: Do not send content that “spoofs” or otherwise disguises the true origin of your transmissions.
  • Keep it clean and Be Kind: Do not access, download, or transmit objectionable material containing data that is:
    • Pornographic, lewd, indecent, or obscene;
    • Fraudulent, libelous, defamatory, or intended to facilitate the commission of a crime;
    • Contain computer viruses;
    • Harass, threaten, advocate, or encourage violence against any individual, group, organization, or government;
    • Violate copyright or contractual terms; or
    • Directly or indirectly expose Albertsons to civil or criminal liability.

While the examples above are not a complete list, you can see that prohibited conduct is not something you do by just surfing the Web, but intentional actions.

Engaging in prohibited conduct or other improper use of the Wi-Fi is strictly prohibited. We reserve the right to investigate potential violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations. Depending on the severity of the violation, you may face civil or criminal liability.

Privacy

We understand that privacy is important to you, and we want to be transparent about what we collect when you connect to the Wi-Fi and why we collect the information.

When you access or use our Wi-Fi, we receive information that may identify you or the device you are using. That information may include the device’s MAC address, IP address, and unique device identifier such as a name or number assigned to the device. If you logged in or were required to register to access or use the Wi-Fi, then the information we collect may include your name, phone number, loyalty member number, and email. We may also receive the real-time location of your device while it is accessing the Wi-Fi.

We use the information collected to provide access to the Wi-Fi, troubleshoot or otherwise address issues related to the Wi-Fi and for general administrative and compliance purposes. We may also store your MAC address to streamline future uses of the Wi-Fi.

In providing access to and operating the Wi-Fi, we may also receive certain information about the content you access, send, receive or use while accessing the Wi-Fi, such as URLs (for example, www.albertsons.com) and IP addresses for transmissions via HTTP or HTTPS, search terms, application commands, files names, file sizes, and file types. We may also receive certain information about communications you may engage in, access, send, receive or use while accessing the Wi-Fi, such as any of the information noted above, and address information, such as recipient and sender email address, or recipient or sender phone number in the case of text messaging via phone when such information is transmitted via an unencrypted manner. We may use this content and communications-related information for the following purposes and will retain the information consistent with these uses:

  • To filter or block inappropriate content, such as adult content or pornography;
  • To provide reasonable security measures such as logging and monitoring use of the Wi-Fi to help prevent unauthorized access;
  • To ensure an appropriate level of consistent Wi-Fi, including the availability and speed of the Wi-Fi, subject to applicable disclaimers and limitations described herein;
  • To address and troubleshoot potential and actual problems with the Wi-Fi; and,
  • To disclose information to law enforcement and government agencies as may be deemed necessary, in their or Albertsons’ discretion, consistent with applicable legal requirements.

By using our Wi-Fi, you are consenting to our receipt, collection, use, storage, and disclosure of this information. You agree and understand that we may, but are not required to, proactively monitor content, communications, and activities undertaken using the Wi-Fi.

Security

We take reasonable steps to keep the Wi-Fi free of security risks such as malware and spam, but we cannot guarantee that it will be secure or free from security risks. As you know, there are risks with the Internet in general and we do not have control over third parties, their websites, and other users. In other words, security is a shared responsibility, and below are some action items you can take to protect yourself and your device:

  • Protect Your Device: Install and use up-to-date malware and virus protection on the device you use to access or use the Wi-Fi;
  • Be Cautious: Avoid communications and websites that convey malware, such as phishing emails;
  • Stay Up-To-Date: Install the most recent security patches made available by your device and operating system provider;
  • Keep Passwords to Yourself: If you were required to use log-in credentials to access the Wi-Fi, maintain these credentials confidentially, including refraining from sharing them with anyone or maintaining them in an insecure fashion, such as by displaying them in a place that is visible to others; and
  • Speak Up: Notify us immediately of any security issue you may detect concerning the Wi-Fi.

Ultimately, you are responsible for your own security and for implementing the protections you deem appropriate to protect yourself from the potential bad actors.

Third-Party Disclaimer

We have no control over the websites that you choose to visit, materials you receive or access through the Wi-Fi, or the information these third parties may collect about you. It is your responsibility to evaluate and determine the privacy and security practices of these third parties, and whether you want to access their website and materials.

Limitation of Liability

YOU ACKNOWLEDGE THAT ANY COMMUNICATIONS OR INFORMATION ACCESSED, SENT OR RECEIVED DURING USE OF THE WI-FI MAY NOT BE SECURE AND MAY BE INTERCEPTED OR OBTAINED BY UNAUTHORIZED PARTIES. YOU UNDERSTAND AND ACKNOWLEDGE FULL RESPONSIBILITY FOR USE OF THE WI-FI AND THAT SUCH USE IS AT YOUR SOLE RISK AND DISCRETION.

UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL OR EQUITABLE THEORY, WHETHER IN TORT, CONTRACT, STRICT LIABILITY OR OTHERWISE, SHALL ALBERTSONS OR ANY OF ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, VENDORS, OR SUPPLIERS (EXCEPT IN THEIR CAPACITY AS USERS OF THE WI-FI) BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL LOSSES OR DAMAGES OF ANY NATURE ARISING OUT OF OR IN CONNECTION WITH THE USE OF OR INABILITY TO USE THE WI-FI, OR FOR ANY INFORMATION, PRODUCTS, WI-FIS, OR OTHER NETWORKS ACCESSED OR OBTAINED THROUGH THE WI-FI INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOSS OF GOODWILL, LOSS OF DATA, LOSS OF PRIVACY, WORK STOPPAGE, ACCURACY OF RESULTS, OR COMPUTER OR FAILURE OR MALFUNCTION, EVEN IF AN AUTHORIZED REPRESENTATIVE OF ALBERTSONS HAS BEEN ADVISED OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. THIS DISCLAIMER APPLIES WITHOUT LIMITATION, TO ANY DAMAGES OR INJURY ARISING FROM ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUSES, FILE CORRUPTION, COMMUNICATION-LINE FAILURE, NETWORK OR SYSTEM OUTAGE, DATA THEFT OR DESTRUCTION, UNAUTHORIZED ACCESS TO, ALTERATION OF, LOSS OR USE OF ANY RECORD OR DATA, AND ANY OTHER TANGIBLE OR INTANGIBLE LOSS. YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT ALBERTSONS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY DEFAMATORY, OFFENSIVE, ILLEGAL, OR OTHERWISE INAPPROPRIATE OR OBJECTIONABLE CONTENT MADE AVAILABLE VIA THE WI-FI, OR CONDUCT OF ANY USER OF THE WI-FI. YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY OF THE ABOVE CLAIMS OR ANY DISPUTE WITH ALBERTSONS IS TO IMMEDIATELY DISCONTINUE USE OF THE WI-FI. BECAUSE SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, OR THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, ALL OR A PORTION OF THE ABOVE LIMITATIONS MAY NOT APPLY.

Indemnification

Indemnification is a legal concept that essentially means one party agrees to pay the losses incurred by another to a third party. In other words, if your use of our Wi-Fi leads to a legal dispute or claim against us, our affiliates, or any officer, director, employee, or others associated with us (except in their capacity as Wi-Fi users), then you agree to pay the costs and losses (losses, liabilities, expenses, damages, costs, attorneys’ fees, court costs, etc.) that are incurred based on the legal dispute or claim.

Typically, common Internet use will not lead to a legal dispute or claim. But if you decide to do something bad while on our Wi-Fi then we need to be protected from your actions. In such instances, we also reserve the right to assume exclusive defense and control of any matter otherwise subject to indemnification and you agree to cooperate with us in the defense.

Changes to the Wi-Fi and Terms

We may change, terminate, limit, or suspend the Wi-Fi or modify these Terms at any time without notice to you. If the changes are unacceptable or become unacceptable to you, your only right is to terminate your use of the Wi-Fi.

Severability

Laws change all the time, so if any part of the Terms are deemed unenforceable in the future, the other parts will still apply.

No Assignment by Wi-Fi User

The Terms are specific to you. In other words, the rights and responsibilities detailed here cannot be signed over by you to someone else without first getting our consent.

Ability to Accept Terms

You warrant and represent that you have the legal authority to accept these Terms on behalf of yourself and all persons and legal entities you represent. By clicking to accept the Terms or by accessing or using the Wi-Fi, you signify your agreement and the agreement of all persons or legal entities you represent, including the owner of the device (if applicable), without limitation or qualification, to be bound by these Terms. You further warrant and promise that you have the legal capacity to enter into this agreement and these Terms or, if not, that your parent(s) or legal guardian(s) have consented to your use of this Wi-Fi and accept these Terms on your behalf.

If you do not agree with each provision of these Terms, or you are not legally authorized to accept these Terms, you may not use the Wi-Fi.

Entire Agreement

These Terms and Albertsons Privacy Policy constitute the entire agreement between you and Albertsons regarding your use of the Wi-Fi and supersede any prior or contemporaneous agreements between you and Albertsons regarding the use of the Wi-Fi.
